Harlan Drake, who is accused of fatally shooting an antiabortion-rights protester outside a Michigan high school last month, has been found competent to face murder charges, the AP/Lansing State Journal reports. Drake is charged with killing the protester, James Pouillon, and a local businessman. His competency depends on his understanding of the charges against him and his ability to assist his defense.
On Tuesday, a judge accepted the latest report on Drake, who was found incompetent less than a month ago. According to the AP/Journal, his mental health has improved after receiving treatment. Drake's lawyer, Robert Ashley, could still introduce an insanity plea if the case goes to trial. Ashley also is trying to obtain a separate evaluation of Drake's mental state at the time of the shootings (AP/Lansing State Journal, 10/27).
