Defense attorneys for Scott Roeder, the man accused of fatally shooting abortion provider George Tiller in the doctor's Wichita church, have subpoenaed two state prosecutors who tried unsuccessfully to convict Tiller on criminal charges, the AP/Miami Herald reports.

Defense attorney Mark Rudy said on Tuesday that misdemeanor charges brought against Tiller by former Kansas Attorney General Phill Kline (R) and separate charges prosecuted later by Deputy Attorney General Barry Disney (R) demonstrated that they both thought Tiller's actions had been lawless. Rudy did not explain details of how the two prosecutors' testimonies could aid Roeder's defense, but he said there are potential defenses that could be raised according to the lawfulness or unlawfulness of Tiller's conduct. According to the AP/Herald, a possible defense strategy could be to ask jurors for a conviction on a lesser charge, such as voluntary manslaughter (Hegeman, AP/Miami Herald, 1/6).
