The Avian Influenza and Influenza of Avian Origin in Mammals (England) Order 2006 Adobe acrobat pdf file (202 KB) came into force on 27 April 2006. It implements the majority of the requirements of Council Directive 2005/94/EC on the control of avian influenza. It replaces the Diseases of Poultry (England) Order 2003 as far as it relates to avian influenza. The new Order has been made before the end of the consultation period because avian influenza virus was found in poultry in Norfolk on 26 April 2006.

We had already agreed with key industry organisations that we would make the Order quickly should the need arise so that the most up to date controls were in place. We will amend the Order should there be any issues of substance that arise from additional consultation responses that are received.

The Avian Influenza and Newcastle Disease (England and Wales) Order 2003 extends to these two diseases new powers introduced by the Animal Health Act 2002, allowing a preventative or firebreak cull of poultry, providing powers of entry to test and sample and allow the slaughter of vaccinated poultry, with compensation.

The powers were sought as part of our Emergency Preparedness Programme in the light of increased concerns about the Spring 2003 outbreak of avian influenza in the Netherlands and Belgium and in advance of the autumn migratory season, given that these diseases could be introduced by waterfowl.
