ACCC Authorizes Medicines Australia Code Of Conduct

The Code sets a very high standard for the marketing and promotion of prescription medicines in Australia. The updated Code was developed in consultation with, and feedback from, consumer groups, peak medical associations (eg AMA, RACGP, ADGP), and pharmacy groups.

"Medicines Australia acknowledges the ACCC's decision to authorise the Code of Conduct," said Mr Kieran Schneemann, CEO of Medicines Australia.

"We appreciate the ACCC's recognition of the Code as valuable in ensuring public confidence in the relationship between the pharmaceutical industry and healthcare professionals.

"The Code is taken very seriously by MA member companies - complaints are assessed by an independent committee, and breaches are strictly enforced," said Mr Schneemann.

Complaints against the Code of Conduct can be lodged by any member of the public. All complaints are assessed by an independent committee made up of representatives appointed by peak medical associations, lawyers with significant expertise in trade practices law, and a consumer representative. Breaches of the Code can attract fines of up to $200,000 and requirement for corrective action.

The ACCC's authorisation includes a condition that requires careful consideration by Medicines Australia. Medicines Australia will consider the condition before making any response.
