BDA Welcomes High Court's Decision To Reject Unfair Termination Clause In PCT Contracts, UK

The British Dental Association (BDA) applauds the High Court's decision to rule against primary care trusts imposing an unfair termination clause in a dental contract, following Eddie Crouch's legal challenge this week.
Peter Ward, BDA's chief executive said:
"We are delighted that Eddie Crouch won his case against the unreasonable term in his dental contract with South Birmingham PCT.
"This establishes an important principle which is of great significance to the dental profession. The BDA was pleased to support Dr Crouch's case, as we believe that the imposition of a clause allowing a PCT to terminate a dentist's contract at any time, and without cause, is contrary to the regulations which underpin the 2006 reforms.
"Had the PCT succeeded in validating this clause, it could have had a detrimental impact on all dentists working in the NHS in England and Wales."
The British Dental Association (BDA) is the professional association for dentists in the UK. It represents over 20,000 dentists working in general practice, in community and hospital settings, in academia and research, and in the armed forces.
